A stipulation in a broker's contract for compensation in the event of a sale by the owner himself is valid, where the broker has used ordinary diligence to make a sale of the property. Fut-rell v. Reeves, 176 S. W. 1151, 165 Ky. 282.

The owner of land may not, while it is in the hands of a broker for sale, consummate a sale with one who has become interested as proposed purchaser through the broker's efforts, and thereupon escape liability for a commission.
