In a suit for commissions on a sale of land, a petition failing to disclose that plaintiff procured a purchaser ready, able and willing to buy, or that defendant interfered with the sale, or delayed its consummation until after the expiration of contract, is subject to general demurrer, notwithstanding an allegation that immediately after the contract expired defendant sold the property to one who had been negotiating with plaintiff, in view of Civil Code 1910, Sec. 3587.
