Where, in an action to recover commissions for a sale of defendant's homestead, their answer alleged that plaintiffs were to procure the wife to join in the contract, and that she refused to do so, the burden was on the defendant to prove such fact. Merlin v. Sipprell, 93 Minn. 271, 101 N. W. 169.
