In an action by a real estate broker for commissions, in which there was evidence that the principal had sold the property to a purchaser procured by the broker, an instruction that the defendant would not have sold the property if he had known that he had to pay plaintiff a commission, plaintiff could not recover, was properly refused. Enochs v. Paxton, 87 Miss. 660, 44 S. 14.
