Fugitives From This State - Warrant

Whenever the executive of this state shall demand a fugitive from justice from any other state he shall issue his warrant to some messenger, commanding him to receive the fugitive and convey him to the sheriff of the county where the offense was committed.

Manner Of Applying For Requisition

Application to the governor for requisition for the return of a fugitive from justice shall be by petition in which shall be stated the name of the fugitive and the crime charged, the county in which the crime is alleged to have been committed, the time when fugitive fled, the state to which he has fled, giving facts and circumstances tending to show the whereabouts of the fugitive at the time of the application. Petition must be verified by affidavit and have endorsed on it the certificate of the judge of the county court where the crime is alleged to have been committed, that the ends of justice require the return of such fugitive.

Sec. 9.

Expenses Of Requisition

When the punishment of a crime shall be confinement in the penitentiary the expense shall be paid out of the state treasury on the certificate of the governor and the warrant of the auditor; in all other cases it shall be paid out of the county treasury of the county where the crime is alleged to have been committed. The expenses shall be the fees paid to the officers of the state on whose governor the requisition is made and not exceeding twelve cents per mile for all necessary traveling in returning such fugitive. Such accounts must be verified by affidavit and certified to by the judge of the county court before they shall be certified by the governor or paid by the county.
