A defendant sued by a broker for commissions is entitled to an instruction which assumes plaintiff to have acted as broker, where the declaration alleged that defendant agreed to pay plaintiff a fixed sum if plaintiff, as a "broker," would secure a sale to defendant, and plaintiff testified that he acted as a broker.
